This page states the Terms and Conditions under which you may access NEXCOM. Please read this page carefully. If you do not accept the Terms and Conditions stated here, do not use NEXCOM. We may revise these Terms and Conditions at any time by updating this posting and all revisions shall apply retroactively. You should visit this page periodically to review the Terms and Conditions, because they are binding on you. BY ACCESSING NEXCOM, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING TERMS AND CONDITIONS:

Section 1. Purpose of NEXCOM

NEXCOM (Nationwide EXperimental COMmunications) is a next-generation nationwide P25 radio network designed for radio enthusiasts and professionals to connect with each other and experiment with digital radio communications. NEXCOM aims to provide a focused space for radio hobbyists and professionals to explore LMR technologies and communicate with other like-minded individuals around North America.

Section 2. Joining NEXCOM.

Any person who holds a valid US or Canadian communications license is eligible to join NEXCOM. However, joining NEXCOM is not a right and may be denied for any reason. Neither being granted access to NEXCOM nor accessing NEXCOM conveys any right of continued access. Once registered, any designation as a "user", "member", or otherwise is for categorization purposes only and does not convey any special rights or privileges of continued access to NEXCOM. The ability to access NEXCOM may be denied or revoked at any time, without notice and for any reason. Any damages for denial or revocation of access are expressly disclaimed as noted in "Section 5. Disclaimer of Damages".

Section 3. Use of NEXCOM.

We authorize you to connect to NEXCOM solely for your personal, non-commercial use. NEXCOM is NOT an amateur radio system or a GMRS system and does not use callsigns associated with those services. While we allow those with amateur or GMRS licenses to access the network, we do not allow RF equipment for those services to be connected to the network or communications to or from those services. All RF connections and communications are required to adhere to US FCC and/or Canadian ISED commercial/experimental LMR regulations and licensing. Communications which do not transmit over RF (IP consoles like DVMConsole or RadioConsole2, or radio-based VOIP solutions) may be accessed by any users who have registered with the NEXCOM system.

NEXCOM permits encryption communications over the network. However, you are not permitted to use your own encryption keys. You may request an encryption key from NEXCOM and, if one is provided by NEXCOM, you agree to keep the key confidential and not disclose the key to any person or entity without advance written permission from NEXCOM.

Section 4. Disclaimer of Warranties.

NEXCOM does not warrant that the network will operate continuously, reliably, safely, securely, or error-free. If your use of NEXCOM results in the need for servicing or replacing equipment, we are not responsible for those costs.

NEXCOM IS PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

Section 5. Disclaimer of Damages.

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF, OR INABILITY TO USE, NEXCOM. THIS DISCLAIMER APPLIES WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT THAT ANY JURISDICTION DOES NOT ALLOW A DISCLAIMER OF DAMAGES, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM CONNECTION TO, OR USE OF, NEXCOM IS LIMITED TO $10.

Section 6. Indemnity.

You agree to defend, indemnify, and hold harmless our members, our partners, officers, directors, advertisers and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of NEXCOM or your breach of the terms of this Agreement. We shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

Section 7. Privacy Policy.

We may use the information that you provide to us, and any other information of yours that is associated with, or related to, NEXCOM, including but not limited to your name, licensing information, mailing address, physical address, IP address, email address, content of communications, and your use of NEXCOM, for our internal business and we may disclose the information to law enforcement personnel, governmental agencies, legal counsel and/or third parties at any time and for any purpose.
